Event Terms and Conditions.
Definitions
In this Agreement, the following capitalised words have the following specific meanings:
‘Company’ means TONUS Ltd. and the trading name TONUS Wellbeing.
‘Customer’ means a person (including any other person with whom you have a business relationship) attending an Event.
‘Event’ means any happening, occurrence or experience offered on the website, including without limitation classes, workshops, one-to-one coaching, and teacher training.
‘Website’ means www.tonuswellbeing.com, TONUS Wellbeing.
Agreement
The parties to this Agreement are:
the person who makes the booking and enters into the Agreement, and, all Customers made under the same booking, referred to throughout the Agreement as “I”, “you” or “your”, and
our company, TONUS Ltd. registered in England and Wales. Both TONUS Ltd. and the trading name TONUS Wellbeing are referred to in this Agreement as the “Company”, “We”, “Our” and “Us”.
Any booking made on our website represents a legally binding contract, the Agreement, between you, all of our Customers, and our Company. By making the booking on behalf of one or more Customers you confirm that you are authorised to agree to these terms and conditions on behalf of each Customer.
Event Bookings and Cancellations.
Prices for all available Events are displayed on our website. Payments must be made in full, and in the currency stated, by debit or credit card ,or, ClassPass voucher at the time of booking. On the rare occasion that the price for an Event changes, due to unforeseen circumstances, you will have the opportunity to cancel the affected Event booking.
Classes
Q. How late can class booking be made?
You can book a class up to 1 hour before to the advertised start time, subject to availability. You can amend a class booking up to 3 hours before the advertised start time.
Q. How far in advance can you book a class?
You can book a class no more than 90 days before the advertised start date, subject to availability.
Q. What happens if TONUS Wellbeing cancels a class booking?
In the unlikely event that we have to cancel a class, your money will be refunded or credited back to your class pass account, or, you will be offered a swap to another class. We cannot be held responsible for any third-party costs, such as travel bookings or accommodation.
Q. What happens if you need to cancel a class booking?
We will accept cancellations up to 3 hours before the advertised class start time. Your money will be refunded or credited back to your class pass account.
Workshops
Q. How late can I book or amend a workshop?
You can book a workshop up to 7 days before to the advertised start date depending on availability. Amendments to workshop bookings can be made up to 31 days before the start of the workshop.
Q. How early can I book a workshop?
You can book a workshop up to 90 days before the advertised start date depending on availability.
Q. What happens if TONUS Wellbeing cancels a workshop booking?
In the unlikely event of the cancellation of a workshop, we will fully refund you or offer a swap to another workshop. We cannot be held responsible for any third-party costs, such as travel bookings or accommodation.
Q. What happens if you need to cancel a workshop booking?
If your booking has been made within 14 days, we can issue a full refund. We will accept cancellations up to 10 days before a workshop, and, your money will be refunded in full.
One-to-one Coaching
Q. How late can I book or amend a one-to-one coaching session?
You can book a one-to-one coaching session up to 1 day in advance depending on availability. Amendments to one-to-one coaching sessions can be made up to 48 hours before the agreed start time.
Q. How early can I book a one-to-one coaching session?
You can book a one-to-one coaching session up to 31 days before the advertised start time.
Q. What happens if TONUS Wellbeing cancels a one-to-one session booking?
In the unlikely event of the cancellation of a one-to-one session, we will refund your money in full. We cannot be held responsible for any third-party costs, such as travel bookings or accommodation.
Q. What happens if I need to cancel a one-to-one booking?
If your booking has been made within 14 days, we can issue a full refund. We accept cancellations up to 48 hours before the agreed start time.
Stretch Therapy Teacher Training
We do not offer a Stretch Therapy Teacher Training course at this time. We expect to offer this Event in the near future. Please check the website for updates.
Attendance and Conduct
Please make sure that you are ready to take part in your Event at least 5mins before the advertised start time. You will not be admitted to your Event after the advertised start time.
On occasion we may photograph or film the Events. Our staff will notify all attendees of any planned photography or filming that will take place in your Event. As such you and/or your Guests will have the opportunity to decline being photographed or filmed. Your consent to being photographed or filmed is a condition of this contract unless an attendee refuses permission. Our staff will avoid photographing or filming attendees who have withheld consent. The photographs and films may be made available to the public via the website or by other means.
We reserve the right to refuse you and/or your Guest admission or continued participation if you and/or they behave in a disruptive way or in violation of the venue rules, that is likely to cause damage, abuse or injury. This includes the use of mobile phones after being asked to turn them off. We will not issue a refund for the Event if you and/or your Guest are asked to leave.
You are asked to follow all reasonable requests given by our staff or venue staff (for example, without limitation, requests relating to health and safety).
Limitations of Liability
This Agreement does not limit our liability against any personal injury or death arising from negligence, error or omission committed by TONUS Ltd. in the course of delivering services or contractual obligations. Our total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with this Agreement, shall be limited to the total amount received by us from you in connection with the Event or Event(s) giving rise to such liability.
You attend and participate in Events at your own risk. We accept no responsibility for:
loss or damage to personal property
Personal injury; arising from any accidental bodily injury, mental injury, illness, disease, death, wrongful arrest or false imprisonment of or to any person, or loss of or damage to tangible property of any person in connection with TONUS Ltd. including the provision of food or drink. Our liability is specifically excluded in respect of any dietary, health or other special requirements of which we are not informed at the time of booking
Loss of business, financial, economic loss or any indirect or consequential loss or damage.
Force Majeure
We will not be liable for any breach of this agreement which is a result of circumstances beyond our reasonable control.
Rights of Third Parties
A person who is not a party to this contract has no right to enforce any term of this contract. This does not affect any right or remedy of a third party, which exists or is available apart from the Contracts (Rights of Third Parties) Act 1999.
